In the case sub judice, we are asked to decide whether the Commonwealth Court was correct in holding that the First-Level Supervisor Collective Bargaining Act, 43 P.S. 1103.101-1103.701 (the "Act"), violates Article III, Section 32 of the Pennsylvania Constitution and therefore is unconstitutional. The Act applies to a single public employer: appellee Pennsylvania Turnpike Commission (the "Commission") and mandates collective bargaining with the Commissions first-level supervisors. For the following reasons, we agree that the Act is unconstitutional special legislation. Accordingly, we affirm the Commonwealth Court.
