The primary issue in this appeal involves the discovery sanctions imposed by the superior court in response to Penny Hazens failure to turn over the customer lists of her massage parlor. The superior court dismissed Hazens claims for false arrest and malicious prosecution and instructed the jury through an establishment order that the police had probable cause when they arrested Hazen for prostitution. We hold that the superior court abused its discretion in imposing these sanctions.
